However, no matter how experienced a doctor may be, there is always the possibility of human error or unintended negligence.

Recently, a pediatrician administered a six-month-old baby with an adrenaline bitartrate injection which had expired on January 19, 2026, in Hyderabad. The father alleged that the doctor didn’t examine the baby before giving an injection.

Negligence like this can result in serious legal consequences, exposing doctors to hefty legal expenses and reputational harm that may impact their long-term practice.

This is where professional indemnity insurance for doctors comes to a rescue. It is a type of insurance that provides financial protection in case a doctor is sued by a patient for alleged negligence or malpractice.

This insurance provides coverage for litigation costs, liability claims, and related expenses resulting from legal disputes. It has been created to support medical professionals to protect their assets and reputation in the event of a claim or lawsuit.

  • Professional errors or omissions: In instances where doctors unintentionally recommend wrong dosage to patients or couldn’t diagnose an ailment at the right time mistakenly.
  • Medical malpractice: There could be situations when unintended errors during treatment can lead to serious complications, such as a surgical instrument being left inside the patient.
  • Misleading: Sometimes doctors could provide wrong guidance to patients unintentionally. There could also be mistakes on behalf of doctors’ staff such as nurses and junior doctors. This policy also covers negligence on behalf of doctors’ staff.

This further includes investigation of fees and related expenses, legal defense or settlement expenses, representation in any inquest, inquiry, or proceeding connected to the claim.

When a claim should be initiated? 

Typically, the policy gets activated when a legal claim is filed against the doctor for alleged negligence, error, or omission in service. For instance, Mrs. Anita Sharma, a 42-year-old schoolteacher, visited Dr. Raj Mehta, a general physician, complaining of persistent abdominal pain and unexplained weight loss for over three months.

Dr. Mehta diagnosed her with gastritis without ordering further diagnostic tests such as ultrasound or blood work. He prescribed antacids and advised dietary changes. Over the next two months, Mrs. Sharma developed worsening symptoms.

Eventually, she sought a second opinion. Another physician ordered imaging tests, which revealed advanced ovarian cancer. The delay in diagnosis significantly limited her treatment options and reduced her prognosis. She filed a lawsuit against Dr. Mehta for negligence of duty which led to worsening her health. Dr. Mehta promptly informed the insurer about the claim, and the insurer initiated the claim process after investigating its genuineness.

Who can apply for this insurance? 

All certified doctors who have a valid medical registration number obtained from their stat’s medical council. Veterinarian, audiologists Ayush doctors, clinical psychologists can also be covered under this insurance including mistakes by trained/untrained staff members.

Variables that influence insurance costs

Several factors contribute to professional indemnity insurance costs, including specialists who operate in high-risk profiles such as obstetricians or surgeons, might have to pay a higher premium. If the sum insured is higher, the premium will be higher too. A policy of ₹1 crore will have a higher premium as compared to a policy of ₹5 lakh.

Doctors with a history of claims might also be charged more premium in contrast to doctors with a clean record.

Having professional indemnity insurance is highly relevant in today’s scenario because of several factors. Today, patients are more aware of their legal rights with growing awareness through the internet and social media. Several patients approach the consumer courts easily seeking justice against negligence by doctor. A small incident can have a serious impact when amplified on social media, where information spreads rapidly, often without full context or verification.

Allegations can go viral within hours, leading to reputational damage, public scrutiny, media attention, and significant emotional and financial strain on the doctor. Even before the legal process concludes, the doctor’s professional credibility may suffer from irreparable harm.

With the advent of advanced medical procedures, chances of complications and technical errors have also increased, making risk management and professional indemnity coverage more important than ever.
