The Karnataka (State) – Indian Society For Assisted Reproduction (KISAR) oganised a webinar on ‘Opening Pandora Box of ART Bill 2021’ on 29th January 2022. Dr Manjunath C. S., Chairperson, KISAR presided over this event.

Dr Geetendra Sharma, Vice President, FOGSI, discussed the various provisions of the newly enacted ART Act. He pointed out various inconsistencies in the ART Act and the Surrogacy Act and emphasised on the need to make the necessary amendments at the earliest. He further stated that there would be more clarity on the provisions of this Act once the Rules and Regulations are framed.

Advocate Mahendrakumar Bajpai, Director, Institute of Medicine & Law and Advocate – Supreme Court of India, pointed out to the landmark changes brought in the law relating to surrogacy. He also pointed out that the provisions of this Act were too bureaucratic and lacked flexibility, the provisions relating to surrogate counselling were missing, and the rights and responsibilities of the surrogates were not defined properly.

The statutory mandate given to insurance of surrogate was a welcome step, he added.
